Terms of Sale

By placing an order at ascendforyou.store you agree to these Terms of Sale. Please read them before purchasing. If you do not agree to any part of these terms, do not place an order.

The parties

“We,” “us,” and “our” refer to Field & Cairn Trading Co., a Colorado business located at 1950 Pearl Street, Suite 200, Boulder, CO 80302. “You” refers to the customer placing the order.

Pricing and currency

All prices on this website are in U.S. dollars and exclude applicable sales tax and shipping unless otherwise stated. Sales tax is calculated at checkout based on the shipping address. Prices are subject to change without notice; however, the price shown at checkout is the price you pay for that order. We will not retroactively adjust the price of an order that has already been placed.

If a product is listed at a price that is clearly incorrect due to a typographical or pricing-system error, we reserve the right to cancel the order and refund any amount paid. We will notify you by email before doing so.

Order acceptance

Your placement of an order through the website is an offer to purchase. Our acceptance of that order occurs when we send you a written order confirmation by email after payment has been received and processed. We reserve the right to decline any order at our discretion, including but not limited to orders that we suspect are fraudulent, orders that ship to addresses we cannot fulfill, and orders that exceed our normal per-customer quantity limits.

Payment

Payments are processed by Stripe, Inc. We accept Visa, Mastercard, American Express, Discover, and major digital wallets including Apple Pay, Google Pay, and Link. Charges are processed at the time the order is placed.

You represent that you are authorized to use the payment method you provide and that the information you provide is accurate. Unauthorized use of a payment method constitutes a material breach of these terms and may be reported to law enforcement.

Shipping

Shipping terms, carriers, transit times, and costs are described on our Shipping page. Title and risk of loss pass to you upon delivery of the package to the carrier. Tracking information is provided by email when your order ships.

Returns and refunds

Return and refund terms are on our Returns page. In short: unused merchandise in original condition may be returned within thirty days of delivery for a full refund. Custom-stamped or monogrammed items are final sale.

Warranties

We warrant that the products we ship will be free from manufacturing defects in materials and workmanship for a period of one year from the date of purchase. If you find a manufacturing defect during this period, contact us at hello@ascendforyou.store with photos and a description, and we will repair, replace, or refund at our option.

This warranty does not cover normal wear and tear, damage caused by misuse or neglect, damage from accidents, or alterations made by the customer or a third party. Leather goods patina with use; this is expected and is not a defect. Brass develops a warm patina; this is expected and is not a defect.

EXCEPT FOR THE LIMITED WARRANTY ABOVE, ALL PRODUCTS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from your purchase shall not exceed the amount you paid for the product giving rise to the claim. We shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost data, or damage to other property.

Intellectual property

All content on this website — including our brand name, logo, product designs, product photography, written copy, and trade dress — is the property of Field & Cairn Trading Co. and is protected by U.S. and international copyright, trademark, and trade-dress law. You may not reproduce, distribute, or display any of this content without our prior written permission. The maker’s seal we deboss on our products is a registered trademark.

Governing law and dispute resolution

These terms are governed by the laws of the State of Colorado, without regard to its conflict of laws principles. Any dispute arising from a purchase shall be resolved first by good-faith negotiation between the parties; if negotiation fails, by binding arbitration before the American Arbitration Association under its Commercial Arbitration Rules, conducted in Boulder County, Colorado. The arbitrator’s award shall be final and may be entered as a judgment in any court of competent jurisdiction.

Changes to these terms

We may update these terms occasionally. The “last updated” date at the top of this page reflects the most recent revision. Orders placed before a change are governed by the terms in effect at the time of the order.
